| Advisory opinion request regarding whether Jason Brown, board member of the St. Mary Parish Fire District No. 3, may accept a paid fire fighter position with Amelia Volunteer Fire Department, Inc. |

The St. Mary Parish Fire District No. 3 ("District") levies property taxes for fire protection and contracts with Amelia Volunteer Fire Department, Inc. ("Amelia") to provide fire protection services for the District. Jason Brown, a current board member of the District, is interested in accepting a paid fire fighter's position with Amelia. All salaried employees of Amelia are hired and paid by the District.

La. R.S. 42:1113 prohibits a public servant, his immediate family member, or a legal entity in which he has a controlling interest from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.
La. R.S. 42:1121A(2) provides that no former member of a board or commission shall, for a period of two years, following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.
