Answer submitted by Sandra Black, a member of the Kenner City Council, Jefferson Parish, in response to a notice of delinquency issued requesting she amend her personal financial disclosure statements.
Facts:
Sandra Black is a member of the Kenner City Council. Ms. Black was also a member of the Kenner Convention and Visitor's Bureau. The staff issued 5 notices of delinquency requesting that Ms. Black amend her 2008, 2009, 2010, 2011, and 2012 Tier 2 annual pfds to disclose her membership on the Kenner Convention and Visitor's Bureau, which is a nonprofit organization on Schedule L.

Ms. Black has responded stating that she is not required to file the amendments because she is no longer on the Bureau's Board of Directors and the Bureau has been dissolved.

However, the Bureau was not dissolved until August 2011 when the Kenner City Council cut its funding. Ms. Black was nominated by Kenner Mayor in 2006. Ms. Black states that she only attended one meeting in 2009. Ms. Black also asserts that when Mayor Muniz left office on June 30, 2010, that presumably her service on the Bureau ceased as Mayor Yenni did not make any nominations. Mr. Gruntz, the city's attorney states the Bureau's regulations call for each new Mayor to make nomination and appointments. Ms. Black argues that since Mayor Yenni did not nominate or appoint her that she was no longer a member. She did not attend any other meetings.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Advise that the amendments are not required for the 2008, 2009 and 2010 pfds.
