Advisory opinion regarding whether Brian Mistich, a former Regional Engineer for the Office of Public Health, may submit project plans and specifications to the Office of Public Health within two years of the termination of his employment with the Office of Public Health. |

Brian Mistich was a Regional Engineer assigned to the Safe Drinking Water Program, Office of Public Health, Department of Health and Hospitals, in Region IX (St. Tammany Parish & Surrounding Parishes). Mr. Mistich was employed for 22 years and recently retired in February 2013. One of his primary duties was to review water and sewerage projects for conformity with the Louisiana State Sanitary Code and issue a permit to allow construction. These permits were primarily issued to engineers and engineering firms. Since retirement, Mr. Mistich works in the private industry as an engineer consultant. Mr. Mistich seeks advice on whether he may submit plans and specifications to the Office of Public Health for permitting.

La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
