Advisory opinion regarding Curtis Roller, a member of the Ward Four Fire Protection District and District Fire Chief, renting office space from the Ward Four Fire Protection District.
Facts:
First Issue:

Curtis Roller serves as the Secretary/Treasurer of the Ward Four Fire Protection District of Jackson Parish and also serves as the District's Fire Chief. Mr. Roller also owns and operates a fire department consulting company named Louisiana Firefighter Services.

The Ward Four Fire Protection District has an office in the central fire station. Mr. Roller performs services for the Fire District out of this office. He and an employee arrive at the station to perform the day to day activities of the Fire District and respond to calls. The employee is an EMS trained volunteer of the fire district. The employee is not paid by the Fire District, the employee is paid by Mr. Roller. When Mr. Roller and the employee are not performing duties or responding to calls, they fill the remainder of the day doing paperwork for his company. Mr. Roller would like to do paperwork for his business out of the Fire District's office or Mr. Roller would like to rent office space from the Ward Four Fire District.

Second Issue:

Scott Nunn and Jeff Burns are employees of Louisiana Firefighter Services. Mr. Nunn and Jeff Burns are trained to provide preventive maintenance on fire apparatus, general repairs, pump repairs, pump testing, and hose testing. They would like to provide compensated services to the Ward Four Fire Protection District. The Fire District would be billed directly by Mr. Nunn and Mr. Burns with Louisiana Firefighter Services receiving no compensation.

Comments:
The Board declined to render an opinion at the May 2014 since it had not received the requested information. The staff received the requested information after the May meeting.

Law:
La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1111A prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

Recommendations:
Adopt the proposed advisory opinion.
