Advisory opinion regarding whether Jill Prokop, a principal for Albany High School within the Livingston Parish School Board jurisdiction, may sell property to the Livingston Parish School Board.
Facts:
Jill Prokop is the principal at Albany High School, which is within the Livingston parish School Board's jurisdiction. Ms. Prokop owns a majority interest in a tract of land that is adjacent to property currently owned by the Livingston Parish School Board. The School Board is interested in purchasing this property as it would serve as a convenient site for future expansion. This tract of land would not be used to expand Albany High School. The Livingston Parish School Board members have the exclusive authority to purchase the subject property.

Law:
La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1102(2)(a)(i) defines "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.

Recommendations:
Adopt proposed advisory opinion.
