Request that the Board waive the $1,000 campaign finance late fee assessed against Keith Sehon, a candidate for Council Member, District E, City of Slidell, St. Tammany Parish, in the April 5, 2014 election, whose2013 Annual Report was filed 72 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, M. Cliff Dyer, CPA and report preparer for Keith Sehon, states that the Board please reverse any penalties associated with the late filing of the 2013 Annual campaign finance disclosure report due to reasonable cause facts as follows: Mr. Sehon began to raise funds in September 2013. Upon qualifying and reporting for this campaign on February 12, 2014, he read the instructions on the various campaign reports that were to be filed. Next to the Report 30-P, it states Report Covers Period From: "if first report - date of first contribution/expenditure". He said they were under the assumption that since this was the first report that Mr. Sehon had filed, they were to include his first contribution/expenditures that happened in 2013. The original 30-P report was filed timely. He said they received a copy of a letter from the Board of Ethics dated April 25, 2014 stating that the 30-P report needed to be amended and that they needed to file and Annual report for all 2013 activity. He said they prepared the 2013 Annual Report and amended the 30-P as soon as they received the aforementioned letter.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee.
