RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Albert F. Majeau, Jr., a candidate for Chief of Police, City of Harahan, Jefferson Parish, in the April 5, 2014 election, whose 2013 Annual Report was filed 76 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Albert F. Majeau, Jr. states that he is not a politician, but merely a career police officer. He states that he sought the assistance of 2 different campaign managers but after considerable thought, he decided that he could not afford a campaign manager. Every donation and expenditure was recorded on his 30-P report, even though an Annual Report was not filed, shortly after receiving his paperwork at qualification. He was sent a letter from Ms. Jenny Arnaud on April 24, 2014 stating that he should have filed an Annual Report for contributions received in November and December of 2013 (these items were reported on the first 30 day report). He complied and sent an Annual Report along with amended reports by May 6, 2014. He is requesting a waiver of his assessment by the Board of Ethics due to: 1) his lack of knowledge as a first time candidate, of the campaign finance reporting process and many different kinds of reports to be filed and the time line by a candidate for an elected office in Louisiana. 2) The fact all information was reported, even though it was not reported on the correct filed report (first thirty day report instead of an annual report.) 3) During the campaign he states he contacted our office many times requesting information on "in-kind" contributions and "48 hour" reports. Once he was notified by Ms. Arnaud he corrected the reports original filed and re-filed amended reports as soon as possible.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee.
