In connection with his request that the Board waive the late fee assessed for the late filing of the report, Mr. Lionel J. Hicks states that he has never filed a late report. He states that he distinctly remembers mailing his report on April 22, 2014 because he had 4 meetings on that day. He is a sitting councilman and he had a meeting at 9:00 to discuss their garbage contract, at 9:30 he met with a constituent to discuss re-zoning a piece of property, he had a ribbon cutting at 3 p.m. and a council meeting at 6 p.m. to discuss economic development and the regular council meeting at 6:30. He said that at 8:30 a.m. he went to the post office counter inside and he specifically asked the postal worker to postmark the envelope. He thought the envelope with stamped with the date of April 22, 2014 but he guess for whatever reason it was not marked. He says he cannot prove this, he can only give the Board his word.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
