Advisory opinion request regarding Sarintha Stricklin, a member of the Plaquemines Community Care Centers Foundation Board, being appointed to the Metropolitan Human Services District Board.
Facts:
Ms. Stricklin has requested an advisory opinion regarding whether the Code would prohibit her from serving on the Metropolitan Human Services District Board (MHSD) while she serves as a Board member of the Plaquemines Community Care Centers Foundation (PCCCF). She stated that MHSD contracts with PCCCF to provide behavioral health services in Plaquemines Parish. She also stated that she is not compensated by the PCCCF for her service on the Board. The PCCCF is a non-profit organization that serves individuals with mental health issues. The MHSD is a political subdivision, created pursuant to La. R.S. 28:862,et. seq, and funded by the State of Louisiana to provide mental health, addiction and developmental disability services to the residents of Orleans, Plaquemines and St. Bernard Parishes.
Law:
La. R.S. 42:1123(1) provides an exception for participation in the affairs of charitable, religious, nonprofit education, public service, or civic organizations when no compensation is received.
Recommendations:
Adopt the proposed advisory opinion.
