Request that the Board waive the $850 late fee assessed against Joseph Bergeron for failure file a lobbying registration report.
Facts:
Mr. Bergeron registered as an Executive Branch lobbyist on April 21, 2014 for the Louisiana Association of Tax Administrators. He indicated that March 28, 2014 was his first day of activity, as such his registration report was 17 days late. Based upon the late report, Mr. Bergeron was assessed a late fee of $850.

Mr. Bergeron states that on March 28, 2014, he paid for meals at a luncheon which was attended by Executive Counsel for the Department of Revenue to discuss the impact of HB 1087 on local taxing authorities. While he was preparing his Legislative Expenditure report for March, he discovered that he had an obligation to register as an Executive Branch lobbyist due his making the expenditure on the Executive Branch Official.

Law:
La R.S. 24:58D(1) and 49:78D(1) state that any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.
