Waiver request submitted by Francis Naozi Nezianya, a member of the Zachary City Council (East Baton Rouge Parish), regarding a $1,500 late fee for filing his amended 2011 Tier 2 annual pfd 15 days late.
Facts:
Mr. Nezianya received a notice of delinquency requesting that he amend his 2011 Tier 2 pfd as he had filed a candidate pfd rather than the annual pfd that was due and he failed to disclose his income from Zachary City and the Zachary School Board. Income from the school board was disclosed by category on the original pfd but not the income from the city.

Mr. Nezianya disputes the late fee stating that he timely faxed the amendment on November 20, 2012. However, a review of the records show that Mr. Nezianya faxed an amendment to his 2010 Tier 2 annual pfd on 11/20/2012. The nod for the 2011 had not even been issued on 11/20/2012.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance.
