Advisory opinion regarding the application of the post-employment restrictions to Regina Stone, a former employee of the Louisiana Department of Natural Resources and determining whether she is an agency head for purposes of the post-employment restrictions.
Facts:
Regina Stone was a Coastal Resource Scientist Supervisor for West Permits under the Office of Coastal Management of the Louisiana Department of Natural Resources. She had five employee positions under her supervision (one was vacant). Ms. Stone's duties and responsibilities as the Coastal Resource Scientist Supervisor for West Permits included training and supervising the work of subordinate scientists comprising a functional unit of a major environmental regulatory program in the Permits/Mitigation Support Section to carryout the State and federal requirements of the Louisiana Coastal Resources Program; ensure technical accuracy and completeness of all work assignments related to permit matters and projects, as well as constituency with Department, Office, Division and Sectional policies; organized workloads, including planning, scheduling and setting priorities. Ms. Stone reviewed permit applications for compliance with the Coastal Use Program guidelines and made recommendations for permit decisions to the Administrator of the Office of Coastal Management. Ms. Stone participated in establishing section policies/procedures and program revisions. These policies and procedures were subject to final approval by her supervisor and Administrator. Ms. Stone conducted employee evaluations buts such evaluations were subject to her supervisor's approval.

Ms. Stone was recently hired by Providence Engineering and Environmental Group, LLC ("Providence"). Ms. Stone performs wetlands, ecological, and regulatory compliance assistance, biological investigations and reporting, and project management services for the Natural Resource Division of Providence.

Law:
La. R.S. 42:1121A(1) provides no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that former agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed advisory opinion.
