Waiver request submitted by Tina Mayes, a member of the Jefferson Parish Economic Development and Port Commission, regarding a $1,500 late fee assessed for filing her amended 2010 Tier 2.1 annual pfd 61 days late; a $1,500 late fee assessed for filing her amended 2011 Tier 2.1 annual pfd 61 days late; a $1,500 late fee assessed for filing her amended 2012 Tier 2.1 annual pfd 61 days late.
Facts:
Tina Mayes received three (3) notices of delinquency requesting she amend her 2010, 2011 and 2012 pfds to disclose her husband's income from the Louisiana State Police on Schedule B by exact dollar figure. There is no other schedule contained in the Tier 2.1 pfd to disclose income.


Ms. Mayes states that if she had received notice of the 2010 earlier then she would not have made the mistake on the 2011 and 2012 pfds. However, this argument is not compelling since Ms. Mayes recently filed her 2013 PFD and, once again, failed to properly disclose her husband's income on Schedule B. A notice of delinquency is being issued for this pfd.


Ms. Mayes also states that she received the notices of delinquency but placed the letters in a briefcase in January and did not use the briefcase again until March, when she re-discovered the letters.

Ms. Mayes states that January was a stressful month as she is her mother's primary "helper" with doctor's appointments and she was showing signs of forgetfulness and personality changes. This was on top of her other health issues.


Ms. Mayes states she was also dealing with her own medical issues. She states that she is a breast cancer survivor and medication she takes for that can cause uterine cancer. In December 2013, she was scheduled for a hysteroscopy and D&C procedure. She states that the surgery was to take place before Christmas but insurance did not approve it in time. The letter does not provide the dates of actual surgery or recovery time.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
2010 - Suspend all based on future compliance.

2011 - Decline to waive.

2012 - Decline to waive.
