Advisory opinion request regarding Brent Villemarette, the Deputy Secretary of Programs for the Louisiana Department of Children and Family Services, contracting with or being employed by state university schools in the Child Welfare Training Academy after his retirement.
Facts:
Brent Villemarette is currently the Deputy Secretary of Programs for the Louisiana Department of Children and Family Services (DCFS). His duties include the oversight of programmatic initiatives and the development of policy related to child welfare, child development, and child safety. This includes oversight of the Training Unit in the Program Integrity Section under the Division of Programs. He will retire from DCFS on July 23, 2014.

The Child Welfare Training Academy (CWTA) was created in collaboration with the Pelican Center, of which he is a board member, public university schools of social work and the DCFS. He participated in the creation of CWTA both in his position with DCFS and the Pelican Center. If offered, he would like to accept any opportunity for part-time employment or on a contract basis with the CWTA through Southeastern Louisiana University (SLU) and/or other schools of social work. He would be paid through SLU or other public schools regardless if he were employed part time or through a contract.

Law:
Section 1121A(1) states that no former agency head shall, for a period of two years following the termination of his public service as the head of such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.

Section 1121B(1) states no former employee shall, for two years following the termination of his public employment, assist another person for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed.
Section 1102(16) defines "person" as individual or legal entity other than a governmental entity, or agency thereof.
