RE:
Request that the Board waive the $2,500 campaign finance late fee assessed against Kent Savoie, a candidate for Judge, 3rd Circuit Court of Appeals, 2nd District, in the November 4, 2014 election, whose 180-P Report was filed 26 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Craig Childress, CPA and report preparer for Kent Savoie states that on May 29, 2014 they became aware of the fact that the campaign report for 180 days prior to the primary was due on May 8, 2014. Upon realization, they prepared and filed the report as soon as they were able to compile all the necessary information needed for a complete and accurate return.

He says they are a small CPA firm and this is the only Political Campaign for which they provide accounting services. During 2014, they had to re-assign the accounting responsibility for this campaign to a new staff accountant due to the medical problems of their office manager who had previously managed this account for several years. The new accountant utilized and relied upon the prior year's filings and reports to make sure they were staying in compliance with all current year filing requirements. However, with this being the first year that Judge Savoie has run for a major office (and also, since Judge Savoie had been unopposed in prior district judge elections), this is the first year that they can recall the campaign having a requirement to file a campaign report for 180 days prior to the primary.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
