In connection with his request that the Board waive the late fee assessed for the late filing of the report, Lemar F. Marshall states that he request the untimely waiver based on the fact that he never received the late fee assessment in March 2014. The letter was received at his residence and signed for by his wife. He was not made aware of the letter and did not realize that he needed to file for a waiver until he saw a second letter on June 10 that was dated May 8th.
He is asking a waiver of the $600 late fee assessment because his campaign account was closed due to lack of activity. He had a balance of approximately $34.00 that was reduced to zero because of bank fees. He says that he thought that by closing the account and forfeiting his ability to collect from outstanding loans he made to himself in 2010, he would not have to file a report. As soon as he was made aware of his mistake he immediately filed the report.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
