Ms. Adrienne Lay has requested an advisory opinion regarding whether the Code would prohibit her from being employed as the Director of Rehabilitation Services for the St. Bernard Parish Hospital and serving as a board member for the St. Bernard Parish Hospital Service District. Ms. Lay stated that the St. Bernard Parish Council has advised her that she is being considered for the open St. Bernard Parish Hospital Service District Board Position. She stated that, if appointed, she would not receive any compensation for her service on the St. Bernard Parish Hospital Service District Board. Furthermore, Ms. Lay stated that she would recuse herself on any issues regarding the Rehabilitation Department. In addition, Ms. Lay stated that she is an Occupational Therapist and as such is considered an Allied Health Clinical Therapist and not part of the medical staff.

La. R.S. 42:1113B states no appointed member of any board or commission shall bid on or enter into or be in any way interested in any contract, subcontract or other transaction which is under the supervision or jurisdiction of the agency of such appointed member. La. R.S. 46:1076 provides that notwithstanding the provisions of R.S. 42:61 et. seq. or any other law to the contrary, members of the medical staffs of hospital service district facilities may serve on the hospital service district commission.
