Advisory opinion request from Daniel Gillane regarding whether Section 1111C(1)(a) the would prohibit him from receiving compensation to file an E-Rate application for a private high school while he is employed with the Lafayette Parish Public Library.
Facts:
Daniel Gillane submitted an advisory opinion regarding whether Section 1111C(1)(a) the Code of Governmental Ethics (Code) would prohibit him from receiving compensation to file an E-Rate application for a private high school while he is employed by the Lafayette Parish Public Library. Mr. Gillane stated that he is currently employed as a Librarian IV with the Lafayette Parish Library. As a Librarian IV, his job duties include administering the Library's E-Rate application, filing all related paperwork and maintaining all related records.


Mr.Gillane wishes to accept a consulting job with a private high school located in Lafayette to file its E-Rate application. He has stated that no part of his job involves doing E-Rate related services for any private or public school. Further, Mr. Gillane stated that the private school in question does not have a contract with the Library. The E-Rate program is administered by the Schools and Libraries Division of the Universal Services Administrative Company (USAC), an independent, not for profit corporation. USCA was designated by the Federal Communications Commission (FCC) to administer the E-Rate program, which provides discounts for telecommunications services, including high speed Internet, to public libraries and K-12 schools.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
Recommendations:
Adopt the proposed advisory opinion.
