Mr. Ed Markle has requested an advisory opinion regarding whether the Code would prohibit his company, Sky Eye, LLC., from entering a joint venture with Louisiana Tech to develop its drone program while he serves as a member of the Louisiana Board of Regents. Sky Eye, LLC., is in the business of designing, manufacturing, testing and operating Unmanned Aerial Systems(UAS). Mr. Markle stated that Louisiana Tech presently operates a technological incubator for the development of UAS. Further, Mr. Markle stated that while the Board of Regents does approve the overall budget for Louisiana Tech, the specific budgeting and funding is performed by the Louisiana Tech administration. Mr. Markle has stated that the Board of Regents does not have any supervision or oversight over the Louisiana Tech drone program.

La. R.S. 42:1113B states no appointed member of any board or commission, member of his immediate family or a legal entity in which he has a substantial economic interest, shall bid on or enter into or be in any way interested in a contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.
