RE:
Advisory opinion request as to whether Renea Johnson, the wife of a current member of the Winn Parish School Board, may accept a promotion to a leadership position in Winn Parish schools.
Facts:
Renea Johnson has been employed as a classroom teacher in Winn Parish since August 1998 and is currently working as the librarian of Winnfield Middle School. She has applied for multiple leadership positions in Winn Parish including principal, assistant principal and Central Office Supervisor of Instruction in Winn Parish schools.

Mrs. Johnson has recently completed graduate programs qualifying her to become certified as an Educational Leader by the Louisiana Department of Education. Mrs. Johnson's husband, Durane Johnson, is currently in the final year of his first term of office as a Winn Parish School Board member. Documentation was provided from Louisiana Department of Education stating that Mrs. Johnson will be issued an Educational Leader Level 1 certificate as soon as she is employed in this capacity in a Louisiana public school system.

Law:
La. R.S. 42:1119B prohibits an immediate family member of a member of a governing authority or the chief executive of a governmental entity from being employed by the governmental entity.

La. R.S. 42:1119C(2) allows a public servant who has been employed with an agency for at least one year prior to his immediate family member becoming an agency head to maintain his employment and to receive normal promotional advancements.

La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving the governmental entity in which any member of his immediate family has a substantial economic interest.

Recommendations:
Adopt the proposed advisory opinion.
