RE:
Advisory opinion request regarding the Coroner of Orleans Parish, Dr. Jeffrey Rouse, performing mental health evaluations through Tulane University.
Facts:
Dr. Rouse serves as the Coroner of Orleans Parish (Coroner). He is also employed by Tulane University (Tulane) as a physician. One of his duties as a physician with Tulane is to perform mental health evaluations of misdemeanor defendants in Municipal Court to determine their competency to stand trial.

He states that there would never be a circumstance where he would treat a patient through his employment with Tulane who was committed by the Coroner's Office. The Coroner's Office does not provide mental health evaluations to determine whether people are competent. Also, the Coroner's Office sends patients who are committed to be treated to the Interim LSU Hospital or Children's Hospital. As such, he does not send patients to facilities operated by Tulane.

Law:
Section 1111C(1)(a) states that no public servant shall receive any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.




Recommendations:
Adopt the proposed advisory opinion.
