RE:
Request for Rehearing in connection with a $7,500 Order against Lionel Burns, a candidate for Judge, Criminal District Court, Orleans Parish in the October 4, 2008 election, who has failed to pay assessed late fees and a fine for the late filings of his EDE-P and 10-G campaign finance disclosure reports.
Comments:
The Board issued an Order at its July 29, 2009 meeting making the fine and late fees totaling $7,500 assessed against Mr. Burns final and absolute. Rule 1018 states that any person aggrieved may apply to the Board for a rehearing in writing within 10 days from the date of the Board's decision becomes final. A copy of the Order was sent to Mr. Burns' residence on August 3, 2009.

Since the fine and late fees were never paid, correspondence was mailed on August 6, 2010 for the purpose of offering Mr. Burns an opportunity to pay the late fees before proceeding with filing suit in the 19th Judicial District. Mr. Burns contacted the Board requesting a rehearing. The request is untimely.



Recommendations:
Deny the request for rehearing.
