Waiver request submitted by Lindora Baker, a member of the Caddo Parish Comission, regarding a $2,500 late fee assessed for filing her 2012 Tier 2 annual pfd 130 days late.
Facts:
Ms. Baker states that she has no reason for her tardiness for filing an amendment to her annual pfd for 2012. Ms. Baker initially filed a Tier 2.1 annual pfd; however, she was required to file a Tier 2 annual pfd, which discloses additional income than required by the Tier 2.1 and is required to be notarized. Ms. Baker states that being a public servant, working a job and attending to a family consumes quite a bit of your time. She states that she has paid a significant amount of money to Board for late filings. She has $5,000 outstanding in pdf late fees and $5,000 outstanding in campaign finance late fees. She has previously paid $6,820 in campaign finance late fees.

OUTSTANDING CF LATE FEES: $2,000 for her Supplemental Report and $3,000 for a Supplemental Report.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
2012 - suspend all but $1,000 based on future compliance.

2008 - affirm decline to waive.
