| Advisory opinion request regarding Tammy Pike, an employee of the Real Estate Division of the Department of Transportation and Development (RED), and how the post employment restrictions affect her. |

Ms. Pike worked for the RED as a right of way agent until June 30, 2013. Her job duties in that position included providing expert assistance to all persons concerning relocation assistance and advisory services law, policy and procedure. She made recommendations for payment relating to persons, business and not for profit organizations forced to relocate from state acquired land. She developed specifications, obtained plans, prepared and accepted bids and oversaw modifications to residential dwellings to make them decent, safe, sanitary and/or handicapped accessible.
Ms. Pike is currently employed with CSRS Inc. (CSRS) as a right of way manager. Her duties in this position include researching and negotiating rights of way for construction, overseeing all land related legal issues including construction and zoning, and for resolutions and other legal forms related to land acquisitions. CSRS has contracts specifically with the RED. She has not worked through CSRS on any contract involving the RED.

Section 1121B(1) states that no former employee shall, for two years following the termination of his public employment, assist another person for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed.
Section 1121B(1) also states that a public employee shall not render any service which such former employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract during the same two years following his departure.
