Advisory opinion request regarding Kedric Smith being assigned to be an assistant head basketball coach at Peabody Magnet High School when his father, Charles, serves as the head basketball coach and athletic director.
Facts:
Charles Smith became the head basketball coach at PMHS in 1985. He has served as athletic director for PMHS since 1998. His responsibilities in this position include facilitating transportation to and from games, delivering information and forms from the LHSAA and the Rapides Parish School Board to head coaches of each sport, and ensuring each head coach follows the financial procedures with regard to purchasing. There are eighteen (18) coaches under his direction.
The principal assigns coaches to their coaching positions at PMHS. Kedric Smith has served as an assistant basketball coach for PMHS since the 2012-2013 school year. This year he will be employed as a teacher and assistant coach at PMHS.

Law:
Section 1119A states that no member of the immediate family of an agency head shall be employed by his agency.
Section 1102(3) defines an agency head as an administrative officer of an agency who exercises supervision over the agency.
Recommendations:
Decline to render an opinion as the matter involves past conduct.
