RE:
Request that the Board reconsider waiving the $1,450 late fee assessed against Dawn Collins for her failure to timely file her Lobbyist Registration ($1,100) and a lobbyist expenditure report ($350).
Facts:
At the Setember 23, 2013 meeting, Ms. Collins all but $500 of Ms. Collins fine was suspended based upon future compliance with the Lobbyist Disclosure Acts.

Ms. Collins has submitted a timely request for reconsideration which provides a letter from her clients that indicate that Ms. Collins was not actually representing them to lobby.



The original waiver request indicates that Ms. Collins began the Lobbyist online registration in April and after doing the training she learned that the Lobbying she was doing did not require registration by statute since it was "less than 20% of the total activity performed for her clients."

She did not complete the online registration until May 29, 2013, although she indicated in her initial registration that the first action requiring registration was April 8, 2013, thereby making her initial registration late. Ms. Collins stated she did not have access to the April expenditure report form until she called the office on June 4, 2013. She was granted access and filed the same day. This was because she did not complete the registration process until May. Once she received the late fee letter, she contacted the office and filed the report.

Law:
La. R.S. 24:53(A) requires a lobbyist to register within 5 days of their first action requiring registration. La. R.S. 24:55(A). Each lobbyist registered under the provisions of this Part shall file with the board, in the manner provided in this Section, a report of all expenditures incurred for the purpose of lobbying.
La R.S. 24:58D Any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.
