Request that the Board waive the $2,600 campaign finance late fee assessed against Louisiana Legislative Black Caucus PAC, Herbert Dixon, Chairman and Regina Barrow, Treasurer, whose May Monthly campaign finance disclosure report was filed 13 days late.
Facts:
In connection with his request that the Board consider to waive the late fee assessed for the late filing of the report, Cynthia Buggage states that she humbly requests a suspension of the $2600 late fees for the delinquent report. She said that she participated in training via telephone with Mr. Dawson on one day and felt pretty confident that she could get the report in on time on June 10, 2014, however, was not expecting a system glitch. She states that when she got to the step of clicking to send the report and get the validation, she received a successful validation with an error. She said she tried to figure the error out and was unable. She said that knowing that she was told during her training that she should do everything to make sure the report is on the due date, she then copied the report on the 11th and put it in the mail for the mail messengers to pick up and put in the U.S. mail for the capitol mail runs. She said that she was assuming that all mail processes were moving timely and didn't think twice about the report getting to its destination within the next two to three business days. She says she is not sure where the breakdown was, but the report was scanned and submitted as received on June 23, 2014. She said she experienced a similar situation and that there was a problem with the messenger service being understaffed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend the late fee based on future compliance.
