Request that the Board waive the $2,000 campaign finance late fee assessed against Mark Hebert, a candidate for Sheriff, St. Mary Parish, in a future election, whose 2013 Annual Report was filed 125 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Randy P. Battaglio, CPA and report preparer for Mark Hebert states that the Mark Hebert campaign has timely filed all of its past reports without any discrepancies since registering with campaign finance in October 2010. He states he completed his data entry for the Hebert Campaign on January 9, 2014 and remembers trying to transmit the report on or about this date, but he kept getting error messages that the report was not accepted. At that time, he states, he decided to keep a printed copy in his file and try filing this report later along with the other three committees that he is treasurer for. He states that when he filed the other three committee reports later in January, he apparently thought he had already filed the Mark Hebert campaign report for 2013. He did not know he failed to file the annual report until June during a conversation with the IT Department when they were discussing how to make an entry in Leaders for another Candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
