Advisory opinion regarding whether the son of Paul Connick, Jr., the District Attorney for Jefferson Parish, may work for a Porteous, Hainkel & Johnson, LLP at a time when Porteous, Hainkel & Johnson, LLP provides legal services to the Jefferson Parish District Attorney's office.
Facts:
Paul Connick, Jr. is the District Attorney for Jefferson Parish. The law firm of Porteous, Hainkel & Johnson, LLP has provided legal representation in various matters for the Jefferson Parish District Attorney's office and is presently representing the office in two matters pending before the US District Court for the Eastern District of Louisiana.

Mr. Connick's son has recently accepted an offer of employment with the law firm. Mr. Connick's son will not work on and will be "walled" from any work performed on behalf of the District Attorney's office. His son will be salaried and not sharing in any of the firm's profits.


Law:
La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed advisory opinion.
