RE:
Advisory opinion request regarding whether Keith Kimball, a West Monroe Reserve Police Officer and/or Chance Brasiel a full time West Monroe Police Officer, may purchase property from the City of West Monroe which was used exclusively by the police department.
Facts:
West Monroe Police Chief Terrell provides that land in question, to be sold by the City of West Monroe, was used by the West Monroe Police Department as a rifle range and that the West Monroe Police department no longer needs this property. Because the Police Department no longer uses the property, the City of West Monroe desires to sell the property.
Chief Terrell has indicated that Mr. Kimball as a reserve member of the West Monroe Police Department serves as a non-compensated volunteer. Chief Terrell added that neither officer has participated in any manner in the preparation of the property for sale by the City of West Monroe. The Mayor and City Board of Aldermen will be exclusively responsible for the sale of the property.

Law:
La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.


La. R.S. 42:1102(2)(a)(i) defines "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.

Recommendations:
Adopt the proposed advisory opinion.
