| Advisory opinion request regarding whether Lucy Watson can serve on the St. Mary Parish Library Control Board while her son is an employee of the St. Mary Parish Library System. |

Ms. Watson previously served on the St. Mary Parish Library Control Board. However, she resigned when her son became an employee of the St. Mary Parish Library System. At this time, her son has been employed with the St. Mary Parish Library System for longer than one year.

La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in her agency.
La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to her actual knowledge, any member of her immediate family has a substantial economic interest.
La. R.S. 42:1120.4 provides that if any appointed member of a board or commission, in the discharge of a duty or responsibility of her office or position, would be required to vote on a matter which vote would be a violation of La. R.S. 42:1112, she must recuse herself from voting and is prohibited from participating in discussion and debate regarding the matter.
