RE:
Request to withdraw a request for an advisory opinion regarding, Caleb Cooley, the son of the Superintendent of Beauregard Parish Schools, Tim Cooley, applying for a position as a certified teacher with the Beauregard Parish School Board.
Facts:
David Burton, the District Attorney for the 36th Judicial District, requested an opinion as to whether the son of the new Superintendent may be employed with the school system. Tim Cooley is the new Superintendent of Schools in Beauregard Parish. His son Caleb Cooley has a Level 1 Teaching Certificate in the area of Physical Education. Mr. Burton is now requesting that he be allowed to withdraw his request for an opinion since Caleb Cooley had been hired as a physical education teacher which is in his area of certification.

Law:
Section 1119B(2)(a)(i) states any local school board may employ any member of the immediate family of any board member or of the superintendent as a classroom teacher provided that such family member is certified to teach.

Recommendations:
Allow the withdrawal of the request for an advisory opinion.
