Request that the Board waive the $2,500 and $900 campaign finance late fees assessed against Tracey Flemings-Davillier, a candidate for Judge, Criminal District Court, Section B, Orleans Parish in the November 4, 2014 Election, whose 180-P and 90-Pcampaign finance disclosure reports were filed 63 and 9 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Mr. Davillier, chairman for Citizens to Elect Tracey Flemings-Davillier, requests a waiver of the late fees due to the committee's confusion regarding the filing requirements. He was unaware that a filing was required because the campaign had not spent over $2,500 for this election cycle. He states, as a matter of fact, the campaign had not spent any funds for the reporting period. Prior to that, an annual report had recently been filed so he was not aware that a 180-P Report was required. Once he received clarification that a filing was indeed required the reports were subsequently filed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $300 on the 180-P based on future compliance. Decline to waive for the 90-P report.
