Advisory opinion request as to whether Jason Guidry and Cory Vincent may continue in their capacities as volunteer firemen and auxiliary police officers for the Town of Lake Arthur if their business, Gotta Potty, LLC, transacts business with the Town of Lake Arthur.
Facts:
Jason Guidry, co-owner of Gotta Potty, LLC, works as an uncompensated volunteer firefighter and also as a part-time compensated auxiliary police officer for the Town and Lake Arthur. Cory Vincent, co-owner of Gotta Potty, LLC, works as the compensated Assistant Fire Chief and also as a part-time compensated auxiliary police officer for the town.
Gotta Potty, LLC, would like to provide customers with port-a-lets and would need to contract with the Town of Lake Arthur to discharge the contents of the equipment into the town's wastewater system. Gotta Potty, LLC would receive no payment from the town, but would pay a fee per gallon to the town for the material offloaded into the wastewater system.


Law:
La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.




Recommendations:
Adopt the proposed advisory opinion.
