Advisory opinion request from Michael Vince regarding his post employment restrictions after his retirement as an environmental scientist from the Air Permits Division (APD) of the Louisiana Department of Environmental Quality (DEQ).
Facts:
Mr. Vince is a environmental scientist in the APD for DEQ. He has participated in numerous media interviews and public meetings discussing the implications of ozone nonattainment on local communities. He has worked with the statewide planning districts and the metropolitan planning organizations to assist them with their planning and inventory of emissions reduction projects within the Federal Environmental Protection Agency's (EPA) Advance Program for Ozone and Particulate Matter. This work has consisted of providing and communicating information regarding current or anticipated air quality conditions for the various local areas based on statutorily set planning district boundaries.

He was the project manager for the development and enhancement of the DEQ's Emissions Reporting Inventory Center. Permitted industry must report annual emissions into this electronic system.

Law:
La. R.S. 42:1102(16) defines person as an individual or legal entity other than a governmental entity, or agency therof.

La. R.S. 42:1121B(1) provides that "no former employee shall, for two years following the termination of his public employment, assist another person for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed."

Recommendations:
Adopt the proposed advisory opinion.
