RE:
Advisory opinion request as to the interpretation of Section 1491.1E of the Campaign Finance Disclosure Act.
Facts:
Amos Cormier states that he submitted a check drawn on his personal account for payment of the $100 Statement of Organization fee. The staff returned the check informing Mr. Cormier that the check must be drawn from the political committee's account. Mr. Cormier is asking that the Board review the staff's interpretation of Section 1491.1E of the Campaign Finance Disclosure Act.

Law:
Section 1491.1E of the Campaign Finance Disclosure Act states the supervisory committee is hereby authorized to impose a fee not to exceed the amount of one hundred dollars for each statement required to be filed under this Section to be remitted to the supervisory committee together with the statement on or before the time the statement is required to be filed.

Rule 1603A provides that a fee of $100 shall be remitted to the supervisory committee with each statement of organization required to be filed by a political committee.

Rule 1603C provides that all fees paid in compliance with Section 1603 shall be by check drawn upon the designated depository of the political committee.

Section 1491.4D states that the chairman of a political committee shall designate one or more banks as the campaign depository of the committee and shall deposit any contributions received into an account maintained at such depository. No expenditures shall be made by any political committee, except by check drawn on such account or accounts.

Recommendations:
Adopt the proposed advisory opinion.
