RE:
Request for Rehearing in connection with a $2,000 Order against Mark Cockerham, a candidate for Lafayette Parish School Board, District 7, in the October 20, 2007 election who failed to file his Supplemental campaign finance disclosure report that was due February 15, 2008.
Facts:
Mr. Cockerham recently filed his Supplemental campaign finance disclosure for 2007 on September 16, 2010 accounting for $37.72 in expenditures. As an elected official, Mr. Cockerham was required to file if he had any surplus or deficit on the final report filed in connection with the October 20, 2007 election.

Comments:
The Board issued an Order at its April 29, 2009 meeting making the late fee and fine totaling $2,000 assessed against Mr. Cockerham final and absolute for his failure to file his 2007 SUPP report by February 15, 2008. Rule 1018 states that any person aggrieved may apply to the Board for a rehearing in writing within 10 days from the date of the Board's decision becomes final. A copy of the Order was sent to Mr. Cockerham's residence on May 8, 2009.

Since the report was never filed and the fines were never paid, correspondence was mailed on April 21, 2010 for the purpose of offering Mr. Cockerham an opportunity to file the report and pay the fine before proceeding with filing suit with the 19th Judicial District Court.

Pursuant to La. R.S. 18:1505.4.D.1 the Board may garnish the nonexempt portion of the public salary once an Order of the Board has been obtained. The Board has begun the process of forfeiture proceedings against Mr. Cockherham. Mr. Cockerham then contacted the Board requesting a rehearing.


Recommendations:
Deny the request for rehearing.
