| Advisory opinion request by Youngsville Mayor Wilson Viator regarding whether a proposed sewer line that would run through property owned by Mayor Viator would be in violation of the Code of Governmental Ethics. |

There has been planning and design to run sewer lines along Chemin Metairie Parkway located in Youngsville. In order for the sewer lines along the parkway to be connected to the closest sewer pump station in the sewer system of Youngsville, it would have run through property owned by Mayor Viator.
Mayor Viator has donated the right-of-way for the sewer lines to Youngsville and has agreed to pay a portion of the estimated costs to run these lines to the sewer pump station from Chemin Metairie. There are no other available routes to get sewer from the existing pump station to and along Chemin Metairie Parkway other than this route.

La. R.S. 42:1113A(1)(a) prohibits a public servant or member of such a public servant's immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
La. R.S. 42:1123(30) allows a public servant, a legal entity which he has a controlling interest, or a member of his immediate family, from donating services, movable property, or funds to his agency.
