Advisory opinion request concerning J.E. "Jay" Marx, III, a councilman for the City of Monroe, and owner of Southern Hardware & Supply Co., Ltd., potentially selling items to Gardner Denver Thomas, Inc. |

J.E. Jay Marx, III is a councilman for the City of Monroe. He is also the owner of Southern Hardware & Supply Co., Ltd. Mr. Marx would like to sell hardware products to Gardner Denver Thomas, Inc., (GDT).
GDT has signed a cooperative endeavor agreement with the City of Monroe which provides that GDT will locate its Headquarters to the City of Monroe in exchange for adequate business space updated and provided by the City of Monroe. In addition to the cooperative endeavor agreement existing between the City of Monroe and GDT, there have been other transactions between the City and GDT.

Section 1111C(2)(d) prohibits a public servant from performing compensated services to a person that has or seeks a business, financial or contractual relationship with the public servant's agency.
"Services" is defined in Section 1102 as the performance of work, duties, or responsibilities, or the leasing, rental, or sale of movable or immovable property.
