RE:
Request that the Board waive the $240 campaign finance late fee assessed against Bonnie Jackson, a candidate for District Judge, 19th JDC, East Baton Rouge Parish in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 4 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Carl J. Jackson, report preparer for Bonnie Jackson states that it should be noted that this was the first time the candidate filed a finance disclosure report electronically. As the person who prepared the report, he did in fact attempt to submit the report on the due date of October 6, 2014. He says when he hit the submit button he waited to see if he would get a confirmation that the report was in fact received by the Board of Ethics, but he did not get a confirmation. Due to the fact that he attempted to submit the report after hours he was unable to call the office of the Board of Ethics to get confirmation. He assumed incorrectly that he would get a confirmation by email letter and went about his business.

It was not until October 10, 2014 when the candidate received a certified letter indicating that the report was not received that he realized something was wrong. He immediately called the office and was instructed to resubmit the report. He did so and received the electronic confirmation and followed up with a call to make sure the report was received.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
