RE:
Request that the Board waive the $540 campaign finance late fee assessed against Kenyetta Nelson-Smith, a candidate for Member of School Board, District 3, East Baton Rouge Parish in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 9 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Kenyetta Nelson-Smith states that she is requesting to suspend in its entirety, the late fee of $540 assessed to her campaign account in reference to the 30-P Campaign Finance Disclosure Report.

This fee should be waived as it is a direct result of LA Board of Ethics Information Technology (IT) team not returning her voicemail messages left in regards to the system not allowing her to file on her computer in which LEADERS is installed. She said she called and left messages that she needed immediate assistance the week prior to filing since she knew she would be out of town the week the form was due. She says she continued to call while out of town so that she could have someone give her the needed information and in return, have someone complete the form for her as she guided them through. Still, no return call. Immediately upon returning to Baton Rouge, she visited the Board of Ethics to discuss this issue and was told that "returning phone calls are hit and miss".
She did receive assistance during her visit from Gene, given directions to clear the notice that was blocking her from submission, and returned home to complete the form. She says she earnestly attempted to submit the form in a timely manner, but could not do so since only the Board of Ethics IT team could walk her through this process.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend based on future compliance.
