Request that the Board waive the $120 and $420 campaign finance late fees assessed against Geraldine "Geri" Broussard Baloney, a candidate for District Attorney, 40th JDC, St. John the Baptist Parish in the November 4, 2014 Election, whose 30-P and 10-P campaign finance disclosure report was filed 2 and 7 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Ms. Baloney states that the original report was delivered via overnight mail to the Board of Ethics by Dr. Henry L. Hardy. The report was placed in the mail via overnight delivery on October 4, 2014 and was received by the Board of Ethics on October 6, 2014. On October 6, 2014, Dr. Hardy was advised via telephone, that the report must be filed electronically. Dr. Hardy was further advised that if the report was filed electronically on Wednesday October 8, 2014, the candidate would not be placed on the late list and any late charges would therefore be waived.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Waive the $120 late fee for the 30-P report and decline to waive the $420 late fee for the 10-P report.
