RE:
Request that the Board waive the $900 campaign finance late fee assessed against Etta Liciardi, a candidate for Member of School Board, District 3, Jefferson Parish in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 15 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Dr. Etta Licciardi states that she has served as a School Board member since August of 2004 and qualified for the position on August 20, 2014. Her husband of 47 years has had an incredibly difficult health year which has included two strokes and a spinal fusion among other significant health problems. When he had the strokes, he was at their ranch in Loranger. Therefore, the doctors and physical therapy have been clustered in Hammond. Her husband has been unable to drive since June, and she was responsible for taking him to his numerous doctor's appointments on the Northshore.

She says it took only a little more than two weeks for her to realize that she could not fulfill her responsibilities to her husband and participate in an active political campaign.


On September 5th, she drove to Baton Rouge to deliver the withdrawal notice to the Secretary of State. At that time she turned the form into the office, she asked if she was responsible for the candidate reports listed in the information packet supplied to her at the time of qualifying. She was told that she was no longer a candidate and therefore not responsible for candidate reports.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Waive the late fee.
