| Advisory opinion request by Kelton Noce regarding his potential post employment restrictions if he were to accept employment with GRC after being employed as a state liaison with the Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP). |

Mr. Noce's duties with GOHSEP include ensuring municipalities and parish governments are able to receive reimbursements for disaster recovery related grants. He assists them in building their applications and follows them through to the approval process.
Mr. Noce has been offered a position with GRC. GRC assists GOHSEP with closing out projects statewide. His job duties with GRC would be working to close-out projects after all grant reimbursements have been made and processed. He has not participated in closing out projects with GOHSEP at any point during his employment. Finally, the applicants and projects he would close-out with GRC would not be any that he has participated via the application and approval process.

La. R.S. 42:1121B(1) provides that "no former employee shall, for two years following the termination of his public employment, assist another person for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed."
