Advisory opinion request regarding whether Barraza Construction, LLC, wholly owned by the spouse of Stacy Barraza, may lease a parish owned building from the Tensas Parish Police Jury while Stacy Barraza is employed by the police jury.
Facts:
Mrs. Barraza is employed by Tensas Parish Police Jury as the economic development and accounts receivable clerk. Her duties include accepting building permit applications and issuing building permits upon the direction of the parish building official; coding and entering into the parish computer system deposits; completing grant paperwork as directed; handling receivable from the parish landfill; general typing, filing and other clerical duties as directed.

She has no role in the decision to enter into lease agreements over parish property. She is supervised by the parish secretary-treasurer and economic development coordinator, Cathy Darden.

Donald Barraza is the husband of Stacy Barraza and sole owner of Barraza Construction, LLC. Barraza Construction would like to lease an unused shed owned by the Tensas Parish Police Jury.

Law:
La. R.S. 42:1113A(1)(a) prohibits a public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, member of his immediate family, or legal entity in which he has a controlling interest from entering into any contract, subcontract or other transaction under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
