Advisory opinion request concerning Department of Children and Family Services child welfare supervisors engaging in professional services contracts with Northwestern State University. |

Department of Children and Family Services (DCFS) child welfare supervisors, who are supervising child welfare students in their field placements, would like to engage in professional service contracts with Northwestern State University. The contracts would involve work outside regular work hours and would entail refinement of the child welfare competencies for the Bachelors of Social Work and Masters of Social Work students, as well as the development of assessment measures to determine if the competences are met. The contractual work would not be considered as part of the job duties of the DCFS employees.

Section 1113A prohibits a public servant from bidding on or entering into a contract, subcontract or transaction with the public servant's agency.
"Agency" is defined in Section 1102 as the department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity, of which the public servant serves.
