Advisory opinion regarding whether Scot Byrd, a member of the Zachary Taylor Parkway Commission, may be part of a team responding to an RFP issued by the Zachary Taylor Parkway Commission.
Facts:
Scott Byrd is a member of the Zachary Taylor Parkway Commission. Mr. Byrd has served as the Director of Economic Development for Pointe Coupee Parish. He helped form an economic development strategy committee for the North Capital Region. He wrote the strategic economic development plan for the City of New Roads. He also helped with the creation of the parish comprehensive plan for Pointe Coupee.

Mr. Byrd is employed with BBI Architects, which seeks to lead a team including a certified planner, a GIS mapping firm, a traffic engineer, a disaster preparedness expert, and a certified economic developer (Mr. Byrd) in responding to an RFP that was issued by the Zachary Taylor Parkway Commission.

Law:
La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are: (d) Neither performed for nor compensated by any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency; conducts operations or activities which are regulated by the public employee's agency; or has substantial economic interests which may be substantially affected by the performance or nonperformance of the public employee's official duty.

La. R.S. 42:1113B prohibits an appointed member of a board or commission, his immediate family member, or a legal entity in which they have a substantial economic interest, from entering into or being in any way interested in a transaction that is under the supervision or jurisdiction of the board or commission.

Recommendations:
Adopt the proposed advisory opinion.
