Advisory opinion request regarding whether Murphy McMillin can serve as an executive director of the LaSalle Economic Development District (LEDD) while either serving as a board member for LEDD or as a former board member.
Facts:
LEDD has decided to create a non-salaried executive director position. This position would only be reimbursed for automobile travel costs and extraordinary business-related expenses dealing with out of parish promotion of economic development within the parish. Murphy McMillin is a commissioner of LEDD. LEDD would like to have Mr. McMillin serve as the executive director even if he has to resign.
Law:
La. R.S. 42:1113B prohibits an appointed member of any board or commission from bidding on or entering into or being in any way interested in any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such appointed member.
La. R.S. 42:1121A(2) of the Code prohibits a former member of a board or commission, for a period of two years following the termination of his public service on such board or commission, to contract with, be employed in any capacity by, or be appointed to any position by that board of commission.
Recommendations:
Adopt the proposed advisory opinion.
