Waiver request submitted by Jacob Giardina, a member of the Bayou Lafourche Water District, regarding a $1,500 late fee assessed for filing his 2010 Tier 2.1 annual pfd 301 days late; a $1,500 late fee assessed for filing his 2011 Tier 2.1 annual pfd 301 days late; and a $1,500 late fee assessed for filing his 2012 Tier 2.1 annual pfd 307 days late.
Facts:
Mr. Giardina's attorney states that his request is based on a change in his business profile over the last several years. Prior to 2010, Mr. Giardina served as CEO of Cameco Industries. During his time as CEO, he employed a large administrative staff that helped him meet his obligations. Once his company was sold, he no longer employed an administrative staff or secretarial staff that assisted him. Additionally, he states that his post-sale business and family issues have occupied his time. He apologizes for not having complied earlier.

Mr. Giardina served without compensation and without submitting per diem expenses.


Mr. Giardina attended ethics training in 2012, but no other year.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
2010 - Suspend all based on future compliance.

2011 - Decline to waive.

2012 - Decline to waive.
