Waiver request submitted by Duane Hunts, a member of the City of Kenner Housing Authority, Jefferson Parish, regarding a $1,500 late fee assessed for filing his 2010 Tier 2.1 annual pfd 300 days late and a $1,500 late fee assessed for filing his 2011 Tier 2.1 annual pfd 300 days late.
Facts:
Mr. Hunt recalls receiving the notice of delinquency with the forms in triplicate, but did not know anything about the financial disclosure requirement. He contacted the staff and it was explained to him the requirement to file. He then filed the pfd for 2012. He then received a "second notice" regarding the 2010 and 2011 pfds. He then understood why he received the forms in triplicate and filed them immediately.

He states that the $3,000 in late fees would create a financial hardship. He states that he is the sole bread-winner for his family as his wife cannot work. He states that his income has dropped dramatically in the past year as he works on commission and his healthcare costs have risen. He states that he lives paycheck to paycheck and struggles to pay the bills and keep food on the table. He states the slightest added financial burden would tip the scale against him and his family and his credit is stellar right now. He will provide copies of his bank accounts.


It appears that Mr. Hunts received ethics training in 2012.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
2010 - suspend all based on future compliance with the Code of Ethics.

2011 - decline to waive.
